Being charged with a misdemeanor, or any crime, can be devastating and cause friction within your family structure. In California, there are three levels of offenses: felonies, misdemeanors, and infractions. A misdemeanor conviction does not carry the possibility of a prison sentence, but people who are convicted may spend time in county jail and put on
probation for several years. Common misdemeanors in California include driving under the influence, domestic battery, petty theft, lewd conduct, and trespassing. While misdemeanors won’t result in extensive prison time, they will appear on criminal background checks so it’s imperative that you obtain an experienced lawyer who can advocate for you.
At Gilligan, Frisco & Trutanich, we approach every misdemeanor case using the necessary resources needed to best support our clients. Our firm is committed to helping our clients get through difficult times with highly-skilled representation and strong advocacy. Our experienced team of criminal lawyers, including former prosecutors from the LA District Attorney’s Office, will stand by you and communicate every step of the process so you can feel confident in our ability to achieve the best possible outcome for you. While a misdemeanor is a lesser evil of sorts, in that it won’t result in serious prison time, it can still massively disrupt your entire life. Misdemeanors will remain on your record, appearing on background checks. If you believe you have been wrongly charged or need help navigating your case, it is important to contact an attorney that knows the fullest extent of the law, like the lawyers at GFT. We handle all of our client’s needs with compassion, integrity, courtesy, and diligence. You can trust us to guide you through the legal process to help you surmount one of the toughest times in your life and achieve the most optimal legal circumstances given the situation.
Misdemeanors can affect anyone, regardless of their age, gender, or financial status. Fortunately, within the judicial system a misdemeanor is actually a lesser evil because a conviction does not carry the possibility of a prison sentence, but they do carry the potential of time in jail. Standard California misdemeanors are punishable by up to six months in jail and/or a fine of $1000. Aggravated misdemeanors are punishable but up to 364 days in jail and of up to $1000 or more.

Examples of misdemeanor offenses include petty theft, public intoxication, simple assault, disorderly conduct, vandalism, trespassing, and reckless driving.
In any crime case, even one that’s a misdemeanor, you will be arraigned and have to enter a plea of guilty or not guilty. Afterward, you and your defense team will accept the court’s ruling by executing the penalty or deciding to fight it in a trial.
Usually, most job applications only inquire about the status of felony convictions. Others may ask about convictions for a certain period of time, like seven to ten years.
Not really. You may have a summary probation period of one to three years, but you must file for expungement for it to disappear from your record.
When you’re going through a tough time, you need a full team on your side. Our five-attorney firm has all of the resources to attend to our clients’ needs.
